El Cajon and Chula Vista took action on high-profile policies regarding immigration enforcement last week that were pretty much diametrically opposed.<\/p>\n

The cities\u2019 Republican mayors took contrasting, if not entirely divergent, positions.<\/p>\n

El Cajon\u2019s Bill Wells led a narrow City Council majority in voting to file a lawsuit seeking to overturn the state\u2019s nearly decade-old immigrant sanctuary law, something he has railed against for years.<\/p>\n

Chula Vista\u2019s John McCann sidelined himself as his city enacted an ordinance aimed at giving the local government tools beyond the state law to restrict certain federal immigration enforcement efforts.<\/p>\n

How effective either move will be is open to question, though the political context of where the two mayors stood seems clearer.<\/p>\n

El Cajon\u2019s voter registration leans slightly Republican and Wells is running for re-election. Also, he potentially would be a top candidate in a special election for county supervisor in the even more conservative, East County-centric District 2, if incumbent Joel Anderson is elected county treasurer-tax collector.<\/p>\n

McCann is up for re-election in heavily Democratic Chula Vista, after losing the District 1 supervisor race in 2025 to Democrat Paloma Aguirre.<\/p>\n

He said his Navy Reserve status prohibited his involvement in the immigration ordinance, giving only brief explanations that raised plenty of questions.\u00a0One military legal expert wasn\u2019t buying it \u2014 in the strongest terms.<\/p>\n

Rachel VanLandingham, a military law expert at Southwestern Law School in Los Angeles, said McCann is \u201cdead wrong\u201d that being a reservist restricts him from acting on this.<\/p>\n

\u201cHe\u2019s using his reserve status as an excuse instead of exercising integrity and simply stating he\u2019s against the ordinance for political reasons. It\u2019s a cowardly move, and demonstrates lack of integrity \u2014 shameful for a military officer,\u201d VanLandingham, a former judge advocate in the U.S. Air Force and a retired lieutenant colonel.<\/p>\n

The 2017 state statute generally limits or prohibits state and local law enforcement from assisting federal immigration actions, inquiring about immigration status, and sharing information with ICE, with some exceptions when it comes to certain criminal behavior.<\/p>\n

Chula Vista enacted a council-approved ordinance similar to those in other jurisdictions that seeks to restrict federal immigration enforcement personnel from accessing nonpublic city facilities without a judicial warrant or court order. Officials in various cities have said they were compelled to act by what they said were overly aggressive enforcement actions against their residents.<\/p>\n

What made this situation more interesting is that the Chula Vista ordinance was signed by Deputy Mayor Cesar Fernandez, not McCann, who did not vote on the measure or attend the signing ceremony.<\/p>\n

Gary Barthel, managing partner of the Military Law Center in Carlsbad, said he didn\u2019t think McCann\u2019s reserve status would be a problem if he wasn\u2019t on duty, which he wasn\u2019t last week.<\/p>\n

\u201cIf he\u2019s inactive, and not actually on a reserve drill, he could still sign it, in my opinion,\u201d said Barthel, a retired Marine lieutenant colonel.<\/p>\n

McCann did not respond to multiple requests for comment regarding his recusal or his position on federal immigration enforcement, according to Walker Armstrong of The San Diego Union-Tribune. He didn\u2019t return calls for this column, either.<\/p>\n

A U.S. Navy official referred Armstrong\u2019s questions back to McCann\u2019s office, stating only that Department of Defense Directive 1344.10 is \u201cthe overarching guidance governing political activities for military personnel.\u201d<\/p>\n

Armstrong reported the directive explicitly classifies the approval of municipal ordinances as nonpartisan political activity \u2014 a category the directive does not prohibit military members from engaging in.<\/p>\n

McCann was on Navy duty overseas when the ordinance was adopted weeks ago. Here\u2019s what he said at a March 3 meeting when the council voted to advance the measure, according to KFMB Channel 8:<\/p>\n

\u201cAs an officer in the U.S. Navy, I am unable to participate in an item that would specifically inhibit or oppose federal law, therefore I will be recusing myself,\u201d he said.<\/p>\n

That interpretation could suggest the mayor of the county\u2019s second-largest city would be prohibited from passing legislation or speaking out against federal laws that may be detrimental to many Chula Vistans. Conceivably, this could include such things as cuts in Medicaid and Medicare, food programs or environmental protection funding.<\/p>\n

Having a military background is almost always viewed as a plus for politicians, especially in the San Diego region. In particular, having been an officer can suggest leadership qualities to do the job at City Hall.<\/p>\n

But here, McCann is saying his Navy background keeps him from doing an important part of that job \u2014 weighing in on an aspect of immigration enforcement, a vital concern in the region and across the country.<\/p>\n

It didn\u2019t always appear to be that way. McCann has given broader, nuanced positions on the issue before. When he ran for supervisor, McCann told the Union-Tribune:<\/p>\n

\u201cAs Chula Vista mayor and council member, I have opposed sanctuary city ordinances and now oppose the Board of Supervisors\u2019 designation of sanctuary county. I strongly support a path to citizenship for Dreamers and lawful immigrants. However, allowing violent criminals to stay in our community will only increase crime, with the immigrant community often being the primary victims.\u201d<\/p>\n

He also said he agreed with Sheriff Kelly Martinez, who opposed the county policy but abides by the state sanctuary law. In April, he also told the Union-Tribune that \u201cOur (police) department has always followed state law,\u201d while not expressing support for it.<\/p>\n

Nuance is not a word that figures into Wells\u2019 view on the sanctuary law. In recent years, he has advocated for more city police collaboration with federal immigration agents and disparages the state for restricting it.<\/p>\n

Whether the lawsuit, filed for the city by the America First Policy Institute, is worth expending any of El Cajon\u2019s time and resources on is far from clear.<\/p>\n

The Trump administration\u2019s litigation against the sanctuary law has been rejected by the courts, including by the U.S. Supreme Court. In addition to contending federal law overrides state statutes like the sanctuary law, the institute is taking a novel legal tack, according to Alex Riggins of the Union-Tribune.<\/p>\n

The lawsuit argues that California laws that offer benefits to undocumented immigrants amount to a violation of part of the human-smuggling statute that makes it a felony when a person \u201cencourages or induces an alien to come to, enter, or reside in the United States.\u201d<\/p>\n

Here\u2019s a logical, perhaps legal, extension of that. Even if the state doesn\u2019t explicitly offer immigrants benefits, but may provide them because immigration status isn\u2019t screened \u2014 such as emergency room treatment \u2014 that could be deemed a violation of the trafficking law.<\/p>\n

Maybe El Cajon will succeed in attacking the state laws where the Trump administration failed. Regardless, waste of time or not, Wells at least deserves credit for taking a clear stand.<\/p>\n
